In America, if you're arrested, you often have to pay money (bail) to get out of jail while you wait for your trial — which might be months or years away. If you're poor and can't pay, you stay in jail even though you haven't been found guilty of anything. 70% of people in US jails are in this situation. While they wait, they can lose their job, their home, and their family — even if they're found innocent in the end.
The Eighth Amendment prohibits "excessive bail," but doesn't guarantee affordable bail. Cash bail creates a two-tier justice system: wealthy defendants go free, poor defendants sit in jail. Pretrial detention creates devastating consequences: loss of employment, housing instability, child custody challenges, and coercive pressure to plead guilty even when innocent. Studies show that defendants detained pretrial receive 25-40% longer sentences — not because they're more dangerous, but because they're less able to mount a defense. Kalief Browder was 16 when arrested for allegedly stealing a backpack. He couldn't afford $3,000 bail. He spent 3 years on Rikers Island awaiting trial — including 2 years in solitary confinement — before charges were dismissed. He was released and took his own life two years later. This was not an outlier. This is a system. In 2023, 630,000 people were released from jail without conviction — having already lost weeks or months of their lives to pretrial detention.
