Imagine two people walk into a bank, both with the same job, same salary, same savings, and same credit score. One is Black, one is white. The Black person is more than twice as likely to be told "no." This happens all across America, and the proof is in the government's own data.
The Home Mortgage Disclosure Act (HMDA) requires lenders to report every mortgage application and outcome. After controlling for income, loan-to-value ratio, debt-to-income, credit score, and property type, a 2.1x denial rate disparity persists for Black applicants. This is the "residual discrimination" โ€” what remains after you account for all financial factors. Modern analysis uses regression-adjusted matched pairs to isolate race as the remaining variable.
HMDA 2023 CFPB analysis: logistic regression controlling for LTV, DTI, credit score, loan purpose, occupancy type, and MSA. Residual denial rate odds ratio for Black applicants: 2.07 (95% CI: 1.98โ€“2.16). Similar studies: Bartlett et al. (2022) NBER found algorithmic lenders reduce discrimination but don't eliminate it; Black applicants pay 8bps higher interest rates after controlling for risk. Fair Housing Act Section 804 prohibits this; CFPB enforcement actions totaling $1.2B since 2011, but structural disparities persist.
